Seller Terms & Conditions
Definitions
Platform: The MALIQA EL digital platform, including its website, application, systems, and related services.
Seller: An authorized natural person or legal entity using the Platform to list and sell products.
Customer: A user who purchases or orders products from a Seller’s store through the Platform.
Products: Goods offered for sale in accordance with the Platform’s policies and applicable law.
Order: A purchase request submitted by a Customer to obtain one or more Products.
Store: The digital space allocated to the Seller to display Products and receive and manage Orders.
Account: The Seller’s account used to access selling tools and services.
Subscription: The fee payable for a plan or paid services in accordance with the published prices and terms.
Commission: A percentage or amount deducted from the value of sales; MALIQA EL does not currently charge a commission on Seller sales, and the cost is limited to the subscription fee for the paid plan after the trial period, in accordance with the published terms.
Acceptance
These Terms govern the relationship between MALIQA EL (the “Platform”) and the Seller using it to list and sell Products to Customers.
By creating a Seller Account or using the selling services, the Seller acknowledges that they:
Have read, understood, and agreed to comply with these Terms.
Have the legal capacity and authority required to enter into this agreement.
Comply with applicable Algerian laws and regulations.
Are responsible for the Products, information, and data displayed in their Store.
These Terms form part of the contractual framework governing the Seller’s use of the Platform, together with the Terms of Use and other policies adopted by MALIQA EL.
Seller Registration and Account Creation
To create a Seller Account, the applicant must:
Be a natural person or legal entity legally capable of entering into contracts.
Be at least 18 years old.
Have a valid and active Algerian telephone number.
Have a valid bank account or CCP account in Algeria where required for the settlement of payments due.
Provide true, complete, and accurate information.
Agree to the Seller Terms, Terms of Use, and applicable policies.
The Seller must update their information and ensure that it remains accurate throughout their use of the Platform.
Identity and Data Verification
The Platform may request additional information or documents to verify identity, data, or eligibility to sell before creating an Account or during its use.
The Platform may suspend the Account, restrict its services, or terminate it where verification cannot be completed or where the information provided is found to be inaccurate, in accordance with these Terms and applicable laws. Verification requirements may vary depending on the nature and legal status of the Seller.
Account Responsibility
The Seller is responsible for:
Maintaining the confidentiality of their login credentials.
All activities carried out through their Account.
Not sharing login credentials with unauthorized persons.
Immediately notifying the Platform if unauthorized access is suspected.
The Platform shall not be liable for damages resulting from the Seller’s failure to protect their login credentials, sharing of such credentials, or unsafe use of the Account.
Permitted Products
The Seller may list and sell Products falling within the scope of MALIQA EL, including:
Clothing and fashion, shoes, bags, accessories, cosmetics, perfumes, and occasion wear.
Other women-related Products approved by the Platform.
All Products must be legal in Algeria and comply with Algerian legislation and EL MALIQA policies.
The Platform may determine or update the categories of accepted Products in accordance with the development of the Platform and legal requirements.
Prohibited Products
The listing or sale of any Product that violates Algerian laws or EL MALIQA policies is prohibited, including counterfeit, illegal, fraudulent, dangerous, expired Products, or Products that infringe intellectual property rights, as well as inappropriate content or content contrary to public order.
The listing of categories outside the scope of the Platform is also prohibited, including currently: food products, medicines and pharmaceutical products, electronics, and any other categories determined by the Platform.
EL MALIQA reserves the right to remove violating content or Products, restrict, suspend, or terminate the Account, and report the matter to the competent authorities where appropriate.
Product Standards
The Seller must ensure that Products conform to their descriptions, images, and advertised specifications, are free from undisclosed defects, and correspond to the sizes and information provided, while providing clear and genuine images of the Product. The Seller is responsible for the accuracy and correctness of all information provided to the Customer.
Pricing
The Seller has the right to set prices and offer promotions and discounts in accordance with the Platform’s policy, provided that prices and information are clear and accurate and that promotions or prices are not misleading or contrary to applicable laws.
The Platform may take appropriate action against any pricing or promotional offer that violates applicable laws or its policies.
Platform Fees
EL MALIQA does not currently charge any commission on sales, and the Seller retains the full value of their sales. Fees are limited to the subscription fee for the selected plan after the trial period, in accordance with the published prices and terms.
Shipping and Delivery
Responsibilities of the Parties: EL MALIQA provides technical tools for managing Orders and tracking shipments. The Seller must prepare, package, and hand over the Order to the shipping company within the specified period, ensure the accuracy of shipping information, and update the Order status. The shipping company is responsible for transportation and collection in cash-on-delivery transactions in accordance with its terms.
EL MALIQA shall not be liable for delays, damage, or loss of shipments caused by the shipping company, to the extent permitted by law.
Preparation and Shipping Period: The Seller must prepare the Order and hand it over to the shipping company within 1 to 3 business days from confirmation of the Order, unless another period is specified.
Shipping Delays: Where a delay is expected, the Seller must notify the Customer. The Platform may take appropriate action in cases of repeated delays or failure to meet the specified deadlines.
Intellectual Property Rights of the MALIQA EL Platform
All intellectual property rights relating to EL MALIQA, including its name, logo, visual identity, design, systems, and content, belong to the Platform or its licensors. They may not be used or copied without prior permission, except as expressly permitted by the Platform.
Seller’s Intellectual Property Rights
The Seller retains the rights to content they legally own and grants EL MALIQA a non-exclusive license to use, display, and market such content to the extent necessary to operate the Platform and its services. The Seller warrants that they possess the necessary rights to the content and that it does not infringe the rights of third parties.
Returns and Exchanges
All return and exchange requests are subject to the provisions of EL MALIQA’s approved Return and Exchange Policy, which forms an integral part of these Terms.
The Customer has the right to request a return or exchange in eligible cases under the policy, including where the Product is defective or damaged, materially differs from its description or images, or where the wrong Product, size, or color was received.
The Customer may submit a return or exchange request within 7 days from the date of receipt of the Product, unless otherwise required by law or the Platform’s policy.
When a request is accepted, the Seller must process it in accordance with the procedures and deadlines specified in the Platform’s policy, while EL MALIQA retains the right to take the necessary measures concerning Orders or Products that violate its policies or applicable law.
Disputes
Disputes between the Seller and the Customer are subject to EL MALIQA policies and applicable Algerian laws and shall be handled according to the following procedures:
Direct Settlement: Attempting to resolve the dispute amicably between the parties.
Platform Intervention: Reviewing the available information and evidence and intervening as a mediator where appropriate.
Platform Decision: Taking the appropriate action within the limits of its authority and policies.
Legal Escalation: Referring the dispute to the competent authorities where required by law.
EL MALIQA has the right to request the documents and information necessary to examine the dispute, and the parties must cooperate and provide them within the specified period.
Limitation of Liability
MALIQA EL is a digital intermediary platform that provides the technical infrastructure and tools to connect Sellers with Customers and manage Stores, Products, and Orders. It is not a selling party to the sales contract between the Seller and the Customer, except to the extent provided for in these Terms and the Platform’s policies.
Account Termination
Termination by the Seller
The Seller may request termination of their Account at any time, subject to the settlement of existing Orders, outstanding amounts, returns, exchanges, and disputes. Termination does not affect rights and obligations arising prior to the termination date.
Suspension or Termination by the Platform
EL MALIQA may suspend, restrict, or temporarily or permanently terminate an Account in the event of a violation of these Terms, policies, or Algerian laws, including prohibited Products, fraud, misleading information, intellectual property infringement, or misuse of the Platform.
Such action may be taken without prior notice in serious cases or where necessary to protect the Platform and its users or to comply with the law, with the possibility of reporting the matter to the competent authorities where appropriate.
Effects of Account Termination
Termination results in the suspension of access to Account services, and the Seller may not circumvent a suspension or termination by creating a new Account. Rights and obligations arising before termination remain in effect until settled.
Amendments to the Terms
EL MALIQA reserves the right to amend or update these Terms in accordance with the development of the Platform or legal and regulatory requirements.
In the event of material amendments, Sellers will be notified through appropriate means, and the amendments shall take effect on the date specified in the notice or upon publication.
The Seller’s continued use of the Platform after the amendments take effect constitutes acceptance of the amended Terms. If the Seller does not agree, they may stop using the Platform and request termination of their Account, while previously accrued rights and obligations remain in effect until settled.
